Terms of service

Draft version · last updated 8 October 2026

In short: your records belong to you and you can export them any time; you are responsible for your team and your customers’ data; payments are handled by licensed providers; and if a paid plan ends, your shop moves to Free without losing data.

1. About these terms

These terms are an agreement between the business that uses ARCFLUS (“you”, “the shop”) and [Company legal name], a company registered in Ghana under number [registration number] (“ARCFLUS”, “we”). By creating an account or using ARCFLUS you agree to them on behalf of your business.

Our Privacy notice explains how we handle personal data and forms part of these terms.

2. Your account and your team

  • You must be 18 or over and use ARCFLUS for a genuine business.
  • Give accurate details and keep them up to date.
  • Keep your sign-in codes, passwords and devices safe. Tell us at once if you think someone else has access.
  • You decide who joins your business and what they can do. You are responsible for what your staff do in your account.
  • Some actions (such as inviting staff, exporting data or changing payout details) need a verified phone number or email.

3. Your records and our data processing terms

Your records are yours. You can export them at any time, on every plan, including after a paid plan ends. You give us permission to store and process them only so we can provide ARCFLUS to you.

For personal data about your customers, you are the data controller and ARCFLUS is your data processor under the Data Protection Act, 2012 (Act 843). As your processor, we will:

  1. process that data only to provide ARCFLUS and on your documented instructions (your use of the service and settings count as instructions);
  2. keep it confidential, and make sure our staff and providers do too;
  3. apply the security measures described in our Privacy notice (Act 843, section 28);
  4. use only the sub-processors listed in our Privacy notice, under written contracts, and tell you before adding new ones [notice period to be confirmed];
  5. tell you without undue delay if we become aware of a data breach affecting your data, and help you notify the Data Protection Commission and your customers (section 31);
  6. help you respond to requests from your customers to access, correct or delete their data;
  7. when you close your business, let you export your data and then delete it as described in section 11 below, unless the law requires us to keep it.

As the controller you agree to:

  • collect your customers’ data fairly and tell them you keep their records digitally;
  • keep it accurate and only record what you need;
  • register with the Data Protection Commission where the law requires it [guidance for small traders to be confirmed];
  • only send customers messages they have agreed to receive, and honour requests to stop.

4. Plans and billing

  • The Free plan has no time limit. Paid plans add features and higher limits, as shown on our pricing page.
  • Paid plans are bought on the ARCFLUS website through Paystack, by mobile money or card. Prices are in Ghana cedis. [Tax treatment, including VAT, to be confirmed.]
  • Mobile money payments are prepaid for the period you choose and do not renew automatically.
  • When a paid period ends without renewal, you keep your features for a 7-day grace period. After that your business moves to the Free plan. Your records are not deleted.
  • You can cancel at any time. [Refund policy to be confirmed.]
  • We may change prices with at least [60] days’ notice. A change does not affect a period you have already paid for.

5. Payments you collect through ARCFLUS

  • Mobile money requests sent from ARCFLUS are processed by Paystack, a licensed payment service provider. Paystack, not ARCFLUS, receives and settles the money to the payout account you register. [Funds-flow wording to be confirmed by counsel.]
  • A payment is marked as paid only after Paystack confirms it to us directly. Payments you record yourself (cash, or MoMo sent to your own number) are labelled as recorded, not verified.
  • ARCFLUS does not currently add a fee to payments you collect. Paystack charges its own processing fee. We will tell you before introducing any ARCFLUS fee.
  • Before collection is switched on, we check that your payout account matches your business. We may pause collection to protect you or your customers, for example if we suspect fraud.
  • Refunds, disputes and chargebacks follow Paystack’s rules; you agree to help resolve them.

6. Tax and record keeping

  • You are responsible for your own tax obligations and for keeping business records for at least six years, as the Revenue Administration Act, 2016 (Act 915) requires. Export your records regularly and before closing your business.
  • ARCFLUS can add VAT, NHIL and GETFund lines to receipts for VAT-registered businesses. ARCFLUS receipts and invoices are not GRA-certified E-VAT invoices.
  • Reports and the business assistant help you understand your numbers; they are not tax, legal or financial advice.

7. Acceptable use

You must not use ARCFLUS to:

  • break the law, including laws on fraud, money laundering, consumer protection or data protection;
  • sell prohibited or illegal goods or services;
  • send spam or messages people have not agreed to receive;
  • try to access another business’s data, test or bypass our security, or overload the service;
  • copy, resell or reverse-engineer ARCFLUS.

8. Availability and offline use

  • We work hard to keep ARCFLUS available but cannot promise it will never be interrupted, for example during maintenance or provider outages.
  • The phone app can record sales offline. Offline sales are sent when you reconnect. To keep records reliable, a device that has not synced for 72 hours (or the period you set) stops taking new offline sales until it reconnects.
  • We may improve or change features. If we remove a feature you pay for, we will tell you in advance.

9. Business assistant

Where your plan includes it, the business assistant answers questions about your own figures. Its answers can be wrong; check important numbers in your reports. Customer and staff names are pseudonymised before questions are processed, and phone numbers are never sent.

10. Suspension

We may suspend an account that breaks these terms or puts other users, customers or ARCFLUS at risk. Where we can, we will tell you first and give you a chance to fix the problem, and you will still be able to export your records unless the law prevents it.

11. Closing your account or business

  • You can delete your user account in the app. It is deleted after 14 days unless you sign in to cancel.
  • An owner can delete a business after exporting its records. The business can be restored for 30 days, then its data is permanently deleted.
  • We keep a limited set of records after deletion where the law or our legitimate interests require it, as listed in our Privacy notice (for example payment records for MoMo collected through ARCFLUS).

12. Responsibility and limits

[Warranty disclaimers, limitation of liability and indemnity to be drafted by counsel in line with Ghanaian law, including consumer protection rules.]

Nothing in these terms limits liability that cannot be limited under Ghanaian law.

13. Changes to these terms

We may update these terms. We will post the new version here and, for significant changes, tell you in the app or by SMS or email at least [30] days before they take effect. If you keep using ARCFLUS after that, the new terms apply.

14. Governing law and disputes

These terms are governed by the laws of the Republic of Ghana. Please contact us first so we can try to resolve any problem. [Dispute resolution and jurisdiction clause to be confirmed by counsel.]
